ERISA Filing

The Employee Retirement Income Security Act (ERISA) is a federal law that sets minimum standards for employer-sponsored retirement and health benefit plans in the United States. It is designed to protect plan participants by ensuring transparency, consistency, and proper administration.

ERISA requires employers to provide a Summary Plan Description (SPD) that clearly explains plan terms, coverage, and employee rights to all enrolled members. This document must be shared with new employees and updated when plan changes occur.

If a written and updated ERISA plan document is not provided within 90 days of a plan change, employers may face compliance issues and penalties. In addition, businesses with more than 100 plan participants are required to file Form 5500 annually.

POP/Cafeteria Filing

If you deduct insurance premiums from employee pay on a pre-tax basis, a POP document is required to stay compliant.

A POP (Premium Only Plan) allows employees to pay for health, dental, and life insurance before taxes are applied, helping them save up to 30% on federal income tax and FICA with every paycheck. Employers also benefit by reducing their FICA liability by 7.65%.

Without a valid POP in place, pre-tax deductions are considered non-compliant and may result in penalties. POP is also referred to as a Section 125 or Cafeteria Plan.

COBRA Administration

COBRA (Consolidated Omnibus Budget Reconciliation Act of 1985) is a federal law that applies to employer-sponsored group health plans with 20 or more employees. It allows employees and their families to continue their existing health coverage for a limited period after losing eligibility.

Coverage may be extended in situations such as reduced work hours, job loss, job changes, retirement, divorce, or the death of the covered employee. Proper COBRA administration ensures timely notices, accurate tracking, and full compliance with federal requirements.

Non Discriminative Testing

To qualify for tax-favored status, employee benefit plans must not favor key employees or highly compensated employees in eligibility, benefits, or contributions. Federal regulations under IRC Sections 125, 105, and 129 set clear rules to ensure fairness across all employee groups.

Each applicable benefit plan must undergo annual nondiscrimination testing, and the results must be properly documented to demonstrate compliance and avoid penalties.

ACA Reporting

Under the Affordable Care Act, businesses classified as Applicable Large Employers (ALEs) with 50 or more employees must file Forms 1094-C and 1095-C, detailing the coverage offered to employees.

An HRA is not a health insurance policy. Instead, it works as a monthly allowance set by the employer. Employees choose the healthcare services or insurance plans that fit their needs, and employers reimburse expenses up to the defined limit.

Flexible Spending Account
